Uncontested Divorce and Separation:
Uncontested matters are those matters where a couple is able to come to an agreement about the division of their property and custody of any children either independently or with the assistance of a mediator. In such cases Phinney Estate Law can represent one party in memorializing your agreement and completing the paperwork required to get it approved by the court. We can also accompany you to court for the necessary hearing.

Cooperative Divorce and Separation:
Cooperative matters are those matters where a couple agrees to work toward coming to an agreement about the division of their property and custody of any children without resorting to litigation in court. Parties agree to a cooling off period prior to resorting to litigation if the process fails. In such cases Phinney Estate Law can represent one party in negotiation and/or mediation of your agreement, memorializing your agreement, and processing the paperwork required to get it approved by the court. Phinney Estate Law reserves the right to withdraw as counsel if the client opts to resort to litigation.
